Terms of Service

Welcome to Reservly! These terms explain the rules for using our service. We've kept them as simple as possible. By using Reservly, you agree to these terms.

1. What We Provide

Reservly is a booking management platform that helps small businesses:

• Accept and manage bookings via WhatsApp
• Keep track of reservations in one place
• Send automated confirmations and reminders
• Manage tables/appointments

2. Your Account

When you create an account:

• You must provide accurate information
• You're responsible for keeping your password safe
• You must be 18 years or older
• One account per business (no shared accounts)

3. Free Trial & Payments

Free Trial: You get 14 days free to try Reservly. No credit card required.

Subscription: After your trial, you'll be charged monthly or annually based on your chosen plan.

• Payments are processed via PayFast
• No refunds for partial months
• You can cancel anytime - access continues until the end of your billing period
• We may change pricing with 30 days notice

4. Acceptable Use

You agree NOT to:

• Use Reservly for illegal activities
• Send spam or unsolicited messages through our platform
• Try to hack, disrupt, or overload our service
• Use automated tools to scrape data
• Impersonate others or provide false information
• Resell or redistribute access to Reservly

5. Your Data & Content

You own your data. This includes:

• Customer booking information
• Your business profile and settings
• FAQ content you create

You give us permission to:

• Store and process your data to provide our service
• Send messages on your behalf via WhatsApp
• Use anonymised data to improve our AI (never identifying you or customers)

6. Service Availability

We aim for 99% uptime, but:

• We may need maintenance downtime (we'll try to give notice)
• WhatsApp availability depends on Meta's systems
• We're not liable for outages beyond our control

7. Limitation of Liability

Important legal stuff:

• Reservly is provided "as is" without warranties of any kind
• We're not responsible for lost profits, data loss, or business interruption
• Our total liability is limited to what you paid us in the last 3 months
• You use the service at your own risk

8. Indemnification

You agree to defend and hold harmless Reservly from any claims, damages, or expenses (including legal fees) arising from your use of the service, your content, or your violation of these terms.

9. Termination

We can suspend or terminate your account if you:

• Violate these terms
• Don't pay your subscription after multiple reminders
• Use the service in a way that harms others

You can cancel anytime in your account settings. Your data will be deleted 30 days after cancellation (except where we must keep it for legal reasons).

10. Changes to Terms

We may update these terms as our service evolves. We'll notify you of significant changes via email. Continued use after changes means you accept the new terms.

11. Governing Law

These terms are governed by the laws of South Africa. Any disputes will be handled in South African courts.
